What is the 3 10 Year Bar?
- If a person is in the United States unlawfully may be ineligible to receive their resident status for periods of either 3 or 10 years.
- If a person has been in the U.S. unlawfully for less than one year but more than 180 days, they will face a 3-year bar.
- If a person is unlawfully in the U.S. for more than one year, they are barred from returning to the U.S. for 10 years.
