Limits on Certain Work Visas Shall Be Extended Through 2020

This past April, various types of immigration were put on hold via a Trump executive order, citing the COVID-19 pandemic as the reason why. As many individuals across the United States lost their jobs due to the pandemic, President Trump stated that it would be most prudent to halt immigration until the economy stabilizes once again. Now, President Trump has ordered an extension on the initial halting of certain work visas, remarking, “This order will ensure that unemployed Americans of all backgrounds will be first in line for jobs as our economy reopens.” This order initially was a 60-day order, though he has just extended it through the remainder of 2020.

What visas does the extension address?

There are various employment-based visas that were put on hold in the initial April order, though there are several additional visas that were included in the extension of that order, of which took effect on June 24, 2020. Those visas are as follows:

  • H-1B visas for workers in specialty occupations
  • L-1 visas for intracompany transfers
  • H-4 visas for spouses
  • H-2B visas for temporary non-agricultural workers
  • Most J-1 visas for exchange visitors

Are all types of immigration included in the order?

No. Various types of immigration and immigrants are not included in the order, including health care professionals, those working in the food supply chain, all members of the U.S. Armed Forces and their spouses and children, those who are lawful permanent residents and their spouses/minor children, those who are entering the United States for law enforcement and/or national security purposes, and individuals whose entry is deemed to be “in the national interest.”
