Trump Administration to Conduct a Comprehensive Review of DACA

As you know, the Supreme Court recently stated that President Trump’s reason for rolling back DACA, an Obama-era program, was unconstitutional. An important caveat that you should note is that the Supreme Court did not say it was unconstitutional for the Trump Administration to roll back DACA in general, only that the initial reasoning they provided for doing so was unconstitutional. That being said, this was a sigh of relief for many DACA recipients. That being said, this past week, the Trump Administration announced that it will conduct a comprehensive review of the DACA program, meaning that though temporarily, they will not roll back the program, the option is still on the table in the near future.

However, you should note that though the administration appears to be waiting it out, certain actions have been taken. For instance, the acting homeland security secretary Chad Wolf recently stated in a memo that DACA recipients may now only renew their status for one more years, as opposed to two, which was the initial agreement. Additionally, the memo declared that the Trump Administration is no longer accepting first-time applicants to the DACA program.

Rather obviously, such a move is not met without various opinions, both positive and negative. Among the negative responses is Mark Rosenbaum, an attorney who has been fighting for the continuation of DACA on the case that reached the Supreme Court. Reacting to the recent move, he said, “We obviously have no choice but to go back to court. It was illegal the first time, and now it’s a constitutional crisis. It’s as if a Supreme Court decision was written with invisible ink.”
